Our Limited License to You

You acknowledge that Apprentice Now has the right but not the obligation to use and display any postings or contributions of any kind and that Apprentice Now may elect to cease the use and display of any such materials (or any portion thereof), at any time for any reason whatsoever.

Limitations on Linking and Framing

You may establish a hypertext link to the Site as long as the link does not state or imply any sponsorship of your site by Apprentice Now. However, without our prior written permission, you may not frame or inline link any of the content of the Site, or incorporate into another website or service any of our material, content, or intellectual property.

If payment for a course is declined, our system will automatically disable access to our premium materials. Private Facebook Group Access

You may be granted access to Apprentice Now’s private Facebook Group. Please note that this access is not unlimited. Apprentice Now reserves the right to remove any person or entity from the private Facebook Group if it is determined that their actions could be perceived as harmful to the community or to Apprentice Now in general. Actions that promote disingenuous, hateful, or harmful behavior may lead to the removal of such posts and could also result in your removal from the Group.

Interactive Features

This Site may include a variety of features, such as message boards, web logs, chat rooms, and email services, which allow feedback to us and real-time interaction between users, as well as other features which enable users to communicate with each other. Responsibility for what is posted on message boards, web logs, chat rooms, and other public posting areas on the Site, or sent via any email services on the Site, rests with each user. Information and content posted within these public forums may be provided by Apprentice Now staff, Apprentice Now’s outside contributors, or by users not connected with Apprentice Now, some of whom may employ anonymous user names. Apprentice Now expressly disclaims all responsibility and makes no representation as to the validity of any opinion, advice, information, or statement made or displayed in these forums by third parties, nor are we responsible for any errors or omissions in such postings, or for hyperlinks embedded in any messages.

Under no circumstances will Apprentice Now, our affiliates, suppliers, or agents be liable for any loss or damage caused by your reliance on information obtained through these forums. The opinions expressed in these forums are solely the opinions of the participants, and do not reflect the opinions of Apprentice Now or any of its subsidiaries or affiliates.

Apprentice Now has no obligation whatsoever to monitor any of the content or postings on the message boards, chat rooms, or other public forums on the Site. However, you acknowledge and agree that we have the absolute right to monitor the same at our sole discretion. In addition, we reserve the right to alter, edit, refuse to post or remove any postings or content, in whole or in part, for any reason and to disclose such materials and the circumstances surrounding their transmission to any third party in order to satisfy any applicable law, regulation, legal process, or governmental request, enforce these Terms of Service, detect, prevent, or otherwise address fraud, security, or technical issues, respond to user support requests, or protect the rights, property, or safety of our users, or the public.

We occasionally include access to an online community as part of our programs. We aim to make every member feel that their participation adds significant value. Therefore, we reserve the right to remove anyone at any time for not aligning with our community guidelines.

Limited Access to Private Social Media Groups

Apprentice Now may grant you access to private Facebook group(s) or other social media groups (the “Groups”). Once you are granted access to the Groups, you agree to refrain from the following activities, unless explicitly permitted by Apprentice Now:

A. Selling or promoting any products or services to other members of the group without express permission.

B. Using any of the intellectual property or assets from the Program, including but not limited to, graphics, videos, templates, animations, except as expressly permitted in these Terms and Conditions.

Apprentice Now retains the sole and final decision on granting or removing access to any Groups for any reason.

Registration

To access certain features of the Site, we may require you to provide demographic information including your gender, year of birth, zip code, and country. Additionally, if you choose to sign-up for specific features of the Site, such as chat rooms, web logs, or message boards, you will need to register with us using the form provided. This registration may require you to provide personally identifiable information such as your name and email address. You agree to provide true, accurate, current, and complete information about yourself as prompted by the Site’s registration form, and to update this information when it changes. If we have reasonable grounds to suspect that the information is untrue, inaccurate, or incomplete, we reserve the right to suspend or terminate your account and refuse any and all current or future use of the Site (or any portion thereof). UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL APPRENTICE NOW, OUR SUBSIDIARIES, PARENT COMPANIES, OR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF, OR THE INABILITY TO USE, THE SITE, INCLUDING OUR MESSAGING, BLOGS, COMMENTS OF OTHERS, BOOKS, EMAILS, PRODUCTS, OR SERVICES, OR ANY THIRD-PARTY MATERIALS, PRODUCTS, OR SERVICES MADE AVAILABLE THROUGH THE SITE OR BY US IN ANY WAY, EVEN IF WE ARE ADVISED BEFOREHAND OF THE POSSIBILITY OF SUCH DAMAGES.

Dispute Resolution by Mandatory Binding Arbitration and Class Action Waiver

PLEASE READ THIS ARBITRATION PROVISION CAREFULLY TO UNDERSTAND YOUR RIGHTS. Except where prohibited by law, you agree that any claim or dispute that has arisen or may arise between you and Apprentice Now, whether related to this Site, your use of the Site, or otherwise, including disputes related to or arising from the interpretation or application of this arbitration clause, will be resolved exclusively through final and binding confidential arbitration.

You are waiving the right to a trial by jury for any claim or dispute. The rights you would have if you went to court, such as discovery or the right to appeal, may be more limited or may not exist. You may only bring claims against Apprentice Now in an individual capacity and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. Additionally, the arbitrator may not consolidate more than one individual’s claims and may not preside over any form of a representative or class proceeding.

There is no judge or jury in arbitration, and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court (including injunctive and declaratory relief or statutory damages), and must follow the terms of these Terms of Service as a court would.

By agreeing to these Terms, you are agreeing that all disputes will be arbitrated on an individual basis and that you are waiving the right to participate as a plaintiff or class member in any purported class action lawsuit, class-wide arbitration, or any other representative proceeding.

Enforcing Security

You may not use the Site or any of Apprentice Now’s data, systems, network, or services to engage in, foster, or promote illegal, abusive, or irresponsible behavior. In maintaining security, you have no reasonable expectation of privacy while using the Site, as we reserve the right to view, monitor, and/or record activity on the Site without notice. Such recorded activity may be subject to review by law enforcement organizations in compliance with applicable law. We will also comply with all court orders or subpoenas involving requests for information.

Injunctive Relief

You agree that Apprentice Now shall be entitled, in addition to other remedies available at law or in equity, to seek and be awarded an injunction or other appropriate relief to restrain any breach or threatened breach of your obligations under any provision of these Terms of Service. Accordingly, you waive any requirement that we post any bond or other security if Apprentice Now seeks any injunctive or equitable relief to enforce these Terms of Service.

Termination

These Terms of Service take effect immediately upon your registration, response to a request for information, or your first use of the Site, whichever occurs first. Apprentice Now may terminate your right to use the Site or any part of it at any time without notice. Upon termination, you are no longer authorized to access the part of the Site affected by such termination. You may also terminate these Terms of Service at any time by ceasing all use of the Site; however, all applicable provisions of these Terms of Service, which by their nature should survive termination, will continue in effect after termination. This includes, but is not limited to, provisions related to ownership of proprietary rights, indemnity obligations, disclaimers, limitations of liability, and this termination clause.

Waiver & Severability

Failure to insist on strict performance of any provision of these Terms of Service will not operate as a waiver of any subsequent default or failure of performance. No waiver by Apprentice Now of any right under these Terms of Service will be deemed to be either a waiver of any other right or provision or a waiver of that same right or provision at any other time. If any part of these Terms of Service is determined to be invalid or unenforceable pursuant to applicable law, including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision. The remainder of these Terms of Service shall continue in effect.

Entire Agreement

No joint venture, partnership, employment, affiliate, or agency relationship exists between you and Apprentice Now as a result of these Terms of Service or your use of the Site. These Terms of Service represent the entire agreement between you and Apprentice Now with respect to your use of the Site and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and Apprentice Now regarding the Site. You may not assign or transfer any rights under these Terms of Service without the prior written consent of Apprentice Now. 

Digital Millennium Copyright Act (DMCA) Compliance

The Digital Millennium Copyright Act of 1998 (the “DMCA”) provides recourse for copyright owners who believe that material appearing on the Internet infringes their rights under U.S. copyright law. If you believe in good faith that materials hosted by Apprentice Now infringe your copyright, you or your agent may send us a notice requesting that the material be removed or access to it be blocked. Notifications must comply with the statutory requirements of the DMCA. Any notification that fails to comply with these requirements will not be considered sufficient notice and will not confer upon us actual knowledge of facts or circumstances from which infringing material or acts are evident. If you believe that a copyright infringement notice has been wrongly filed against you, the DMCA allows you to send a counter-notice. These Terms of Service shall bind and benefit Apprentice Now and our respective assigns, successors, heirs, and legal representatives. However, we may freely assign all rights and obligations under these Terms of Service to any affiliated entity or any of our wholly owned subsidiaries. These Terms of Service shall be governed by and construed in accordance with the laws of Texas and any dispute shall be subject to binding arbitration in Austin, Texas.
